Background
Aggregate litigation provides vital mechanisms for the enforcement of individual rights, and is especially valuable when smaller amounts of money are at stake for individual litigants. Consolidated proceedings offer the possibility of access to justice with reduced transactional costs and less strain on public resources. As a result, consolidated multi-district litigation cases now comprise nearly 40% of the federal civil caseload, with large numbers of claims involving pharmaceutical and other products liability, environmental exposure actions, and mass accident and disaster cases. Decreased access to federal courts—through procedural hurdles like challenges to jurisdiction, “plausibility” pleading, and forced arbitration—have posed challenges to litigants who need resolution of their claims.
This academic symposium will bring together distinguished academics, judges, and practitioners to consider the present status, current challenges, and possible future outcomes for class actions, mass torts, and multi-district litigation.
